In these terms, “Zaklad”, “we”, “us”, and “our” refer to the operator above. “You” means the individual or organisation using the service.
1. Acceptance
By accessing or using Zaklad, including the web platform, the Figma plugin, the API, and any associated tooling (together, the “Service”), you agree to these terms. If you do not agree, do not use the Service.
2. The Service
Zaklad is a design system platform that lets you manage design tokens, typography, icons, and components, and sync them to Figma and code. The Figma plugin is a companion tool that pulls your Zaklad project data into a Figma file.
3. Your Account
- You must be at least 16 years old and have the legal capacity to enter into a binding contract to use the Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.
- You are responsible for keeping your login credentials and API keys secure.
- You must provide accurate information when registering and keep it current.
- One person per account. Do not share accounts.
- You are responsible for all activity that occurs under your account and API keys, whether or not authorised by you.
4. Your Content, Ownership, and Output
You retain full ownership of all content you create or upload to Zaklad, including design tokens, components, fonts, icons, and any other project data (“Your Content”). We do not claim any rights over Your Content.
To operate the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable-only-to-our-subprocessors licence to host, store, transmit, display, cache, back up, and process Your Content solely as necessary to provide the Service to you and the organisation you belong to. This licence ends when you delete Your Content or your account, subject to the retention periods described in the Privacy Policy.
Output on paid plans: the output generated by the Service from Your Content, including exported token files, generated code, documentation, and Figma libraries, is yours to use, including for commercial purposes, subject to the rights you hold in the underlying inputs. The Zaklad platform and software itself remains the property of the operator and is licensed to you, not sold.
Free plan is for non-commercial use only. Output generated under a free plan may only be used for personal, educational, or non-commercial evaluation purposes. Any commercial use of output generated by a free plan — including use in client work, products sold or licensed to third parties, or in revenue-generating applications — requires an active paid plan at the time the output is generated. If you need commercial use, upgrade to a paid plan first.
5. Asset Rights, Fonts, and Takedowns
You warrant that you own, or have obtained all necessary licences and permissions for, every asset you upload to or use within Zaklad, including but not limited to fonts, icons, illustrations, images, components, code snippets, and third-party design system inputs. This warranty is a condition of using the Service.
We do not and cannot verify the rights you hold in uploaded assets. You are solely responsible for compliance with the licence terms of any third-party assets you use, including commercial-use restrictions, seat limits, webfont embedding terms, and attribution requirements. Uploading an asset to Zaklad does not grant you any rights in it that you did not already hold.
Takedowns. If we receive a credible notice of infringement or a demand from a rightsholder, regulator, or court — for example, a request to remove an asset served via our CDN — we will investigate and, where the claim appears legitimate, disable, restrict, or remove the affected content without advance notice. We will notify the affected account of the action taken where legally permitted.
Violations of this section are grounds for immediate suspension or termination of your account without refund, in addition to any other remedies available to us.
6. Acceptable Use
You agree not to:
- Attempt to access other users’ data, accounts, or projects.
- Reverse-engineer, probe, or attack the platform or its infrastructure.
- Use the Service for any unlawful purpose or in violation of applicable laws.
- Distribute your API keys publicly or embed them in client-side code.
- Upload content that is illegal, infringing, malicious, or that contains malware or exploits.
- Use Zaklad as a general-purpose file host, storage service, or content delivery network for material that is not part of a genuine design system. The Service is provided for design system work; assets, files, and resources unrelated to that purpose do not belong on the platform.
- Share, redistribute, or allow access to CDN-served assets outside the scope of your organisation’s legitimate use of the Service. Hotlinking, public mirroring, or embedding Zaklad-served assets into unrelated properties or third-party products is not permitted.
- Access the Service through automated means other than our official API and plugins, or scrape, crawl, or bulk-download content via the web interface.
- Circumvent or attempt to circumvent rate limits, storage quotas, seat limits, plan limits, or any other technical restriction.
- Resell, sublicense, rebrand, or commercially redistribute the Service or access to it without written permission.
- Use the Service to store or transmit content on behalf of third parties who are not part of your organisation or its authorised collaborators.
We may investigate suspected abuse, suspend access while an investigation is ongoing, and take appropriate action up to and including termination. Repeated or serious violations of this section are grounds for immediate termination without refund.
Responsible security research. Nothing in this section is intended to discourage good-faith security research. If you believe you have found a security vulnerability in the Service, please report it to [email protected]. We will not pursue legal action against researchers who act in good faith, report issues promptly and privately, avoid accessing, modifying, or destroying data beyond what is strictly necessary to demonstrate the issue, and give us a reasonable opportunity to remediate before public disclosure.
7. Beta Status
Zaklad is currently in beta. The Service is provided on an “as is” and “as available” basis. Features, APIs, and data formats may change. We will make reasonable efforts to notify you of breaking changes, but we cannot guarantee uninterrupted service, feature stability, or backwards compatibility during the beta period.
8. The Figma Plugin
The Zaklad Figma plugin modifies your Figma file by creating and updating variables, text styles, icon components, and UI components. By using the plugin, you accept that it will make these changes to the file you run it in. We strongly recommend running the plugin in a dedicated library file rather than a working design file, and maintaining your own version history or backups before running any sync.
9. Availability, Data, and Backups
We make reasonable efforts to keep the Service available and to protect Your Content, but we do not guarantee uninterrupted availability, error-free operation, or that the Service will be free of data loss. Scheduled and unscheduled downtime, infrastructure failures, third-party outages, or other events may cause temporary or permanent loss of data.
You are responsible for maintaining your own backups of any data you consider critical. Zaklad’s export functionality is provided for this purpose. We are not liable for loss of data that you have not independently backed up.
10. Fees and Payment
Paid plans are billed in advance according to the pricing shown at the time of purchase. Fees are non-refundable except where required by law or where set out in our Refund Policy.
Taxes and the Merchant of Record. Payments are processed by a third-party payment provider acting as the Merchant of Record for your purchase. Where VAT, sales tax, or equivalent indirect taxes apply, they are collected by the payment provider and remitted to the relevant tax authority. Prices are shown excluding such taxes unless otherwise stated. The operator of Zaklad is not currently registered for VAT and does not charge VAT separately outside of the Merchant of Record arrangement.
Price changes. We reserve the right to change pricing at any time, including the prices of existing plans, the structure of plans, and the introduction or removal of plans. Price changes do not apply retroactively to periods you have already paid for: if you have paid for a month, a year, or any other billing period, you keep the price you paid for the remainder of that period. Changes take effect at your next renewal. We will give you reasonable advance notice of any material price change before your renewal, and you may cancel before the new price takes effect if you do not agree to it.
Fair use. Each plan has associated limits on storage, bandwidth, seats, API usage, and other resources. These limits are published alongside the plan. Use beyond the published limits, or use that imposes disproportionate load on the Service relative to your plan, is not permitted. In particular:
- Free plans operate under significantly tighter limits and are monitored more strictly. Free plans are intended for evaluation, personal use, and non-commercial work only (see Section 4). Sustained high usage on a free plan is not fair use and may trigger suspension.
- Paid plans include generous headroom for normal use. If your usage consistently exceeds what a plan is designed for, we will contact you to agree an upgrade, a custom arrangement, or a bandwidth / storage cap.
- Enterprise plans are governed by the limits and service terms set out in the enterprise order form or separate agreement, which take precedence over the fair use provisions here to the extent of any conflict.
We may suspend or rate-limit accounts that materially exceed fair use, and may terminate accounts that continue to do so after notice. Use that is abusive, malicious, or that threatens the stability of the Service for other users may be suspended or terminated without notice.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Zaklad and its operator are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of revenue, loss of goodwill, business interruption, or unintended modifications to your Figma files or other systems, arising from or related to your use of the Service, whether in contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
Our total aggregate liability to you for any and all claims arising out of or related to the Service is limited to the greater of (a) the fees you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred euros (€100). For users on free or beta plans who have paid no fees, this limit is one hundred euros (€100).
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
12. Indemnification
You agree to indemnify, defend, and hold harmless Zaklad and its operator from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from or relating to:
- Your Content, including any asset or material you upload to the Service;
- any claim that Your Content or your use of the Service infringes the intellectual property rights, privacy rights, or other rights of a third party, including claims relating to fonts, icons, images, or any licensed asset;
- your use of the Service in violation of these terms, applicable law, or the licence terms of any third-party asset;
- your breach of the asset-rights warranty in Section 5.
13. Termination
You may stop using Zaklad at any time by deleting your account. We may suspend or terminate your access, with or without notice, if you violate these terms, if we receive a credible claim of infringement relating to Your Content, if required by law, or if you abuse the Service.
Immediate termination without refund applies to violations of Sections 4 (ownership and free-plan non-commercial restriction), 5 (asset rights), or 6 (acceptable use), and to any conduct we reasonably determine poses a risk to the Service, to other users, or to us.
On termination, your data will be deleted in accordance with the Privacy Policy. Sections that by their nature should survive termination (including ownership, the asset-rights warranty, indemnification, limitation of liability, and governing law) will survive.
14. Force Majeure
We are not liable for any failure or delay in performing our obligations caused by events outside our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labour disputes, power or internet failures, or third-party infrastructure outages.
15. High-Risk Use
The Service is a design system tool. It is not designed, intended, or authorised for use in environments where failure could lead to death, personal injury, or serious physical or environmental harm, including life-support systems, medical devices, nuclear facilities, aviation, autonomous vehicles, or emergency services. You agree not to use the Service in any such context, and you accept all risk of such use.
16. Export Controls and Sanctions
By using the Service, you represent that you are not located in, and are not a national or resident of, any country subject to a comprehensive EU or US embargo or sanctions programme, and that you are not listed on any EU or US restricted-party list. You agree to comply with all applicable export control and sanctions laws when using the Service.
17. Brand and Trademarks
“Zaklad”, the Zaklad logo, and related marks are the property of the operator. You are welcome to use them, subject to the guidelines in this section. We like seeing Zaklad out in the world.
You may:
- Mention Zaklad by name in articles, social posts, case studies, talks, portfolios, and documentation, including phrases like “built with Zaklad”, “powered by Zaklad”, or “we use Zaklad”.
- Display the Zaklad wordmark or logo alongside a factual reference to the Service, provided you do not alter its proportions, colour beyond what is necessary for contrast on your background, or visual integrity.
- Link to zaklad.app from your own content.
You may not:
- Use the Zaklad name or logo in a way that suggests official endorsement, partnership, certification, or sponsorship without our prior written permission.
- Incorporate the Zaklad name or logo into your own product name, logo, domain, or trademark, or otherwise use it in a way likely to cause confusion about the origin of goods or services.
- Use the Zaklad brand in connection with content that is unlawful, misleading, harmful, or that would reasonably bring the brand into disrepute.
- Modify, combine, or stylise the logo in a way that materially alters its appearance.
If you are not sure whether a specific use is fine, email [email protected] and ask. We are reasonable.
18. Feedback
If you send us feedback, suggestions, ideas, or proposed improvements to the Service (“Feedback”), you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use the Feedback for any purpose, including incorporating it into the Service, without obligation to you. Feedback is provided voluntarily and is not confidential.
19. Changes to These Terms
We may update these terms as the Service evolves. Material changes will be communicated via the platform or by email where practicable, with reasonable advance notice before they take effect. Your continued use of the Service after a change takes effect constitutes acceptance of the updated terms.
20. Governing Law and Jurisdiction
These terms are governed by the laws of the Czech Republic, without regard to its conflict of laws principles. Any dispute arising out of or in connection with these terms or the Service will be subject to the exclusive jurisdiction of the competent courts of the Czech Republic, with venue in Prague, except where mandatory consumer protection laws of your country of residence provide otherwise.
21. Severability
If any provision of these terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
22. Assignment, Entire Agreement, and Notices
You may not assign or transfer these terms or your account without our prior written consent. We may assign these terms in connection with a merger, acquisition, restructuring, or sale of assets.
These terms, together with the Privacy Policy and any applicable Data Processing Agreement, constitute the entire agreement between you and us regarding the Service, and supersede any prior agreements or communications.
Enterprise and custom agreements. If you have signed a separate enterprise order form, master services agreement, or similar negotiated agreement with us covering your use of the Service, that agreement controls where it conflicts with these public terms. Otherwise these terms apply in full.
